What NC Campaign Compliance Involves
Every candidate running for state or local office in North Carolina has legal obligations around how their campaign is organized, funded, and reported. Here's what that looks like.
Committee Organization
Before you can raise or spend a dollar, your campaign committee has to be properly organized with the state. Here is what that involves:
- ● Filing a Statement of Organization (CRO-2100A) within 10 days of your first campaign action
- ● Appointing a North Carolina resident as your campaign treasurer
- ● Ensuring your treasurer completes mandatory NCSBE training within 3 months
- ● Opening a dedicated campaign bank account separate from personal funds
- ● Filing a Certification of Financial Account Number (CRO-3500)
Threshold Determination
NC has different reporting requirements depending on the type of race and how much you raise or spend:
- ● County and municipal candidates who raise or spend $1,000 or less may qualify for reduced reporting by filing a Certification of Threshold (CRO-3600)
- ● If you exceed $1,000 at any point, you must file a new CRO-3600 immediately and switch to full disclosure reporting
- ● Legislative, judicial, and statewide candidates have no threshold option. Full quarterly or semi-annual disclosure reports are required regardless of amount raised or spent.
Financial Reporting
Once your committee is active, ongoing financial reporting is required. Getting this wrong can lead to fines, audits, or worse:
- ● Donor name, address, and date must be collected for all contributions
- ● Occupation and employer are required for contributions over $50
- ● 48-Hour Reports must be filed within 48 hours of receiving $1,000 or more after your last regular reporting deadline before an election
- ● Each report must include a Detailed Summary (CRO-1100) of all contributions and expenditures
- ● The treasurer signs and certifies each report as true and correct
